1.2 No Liability for User Content

DRISHYAALOK, ITS OWNERS, OPERATORS, EMPLOYEES, CONTRACTORS, AND AFFILIATES SHALL NOT BE LIABLE FOR:

• Content uploaded by users
• Copyright infringement by users
• Defamatory statements in user content
• Privacy violations by users
• Illegal content uploaded by users
• Harm caused by user-generated content
• Disputes between users
• Accuracy or quality of user content

2. USER RESPONSIBILITY

2.1 Uploader Liability

USERS WHO UPLOAD CONTENT ARE SOLELY AND EXCLUSIVELY RESPONSIBLE FOR:

• Ensuring they own all intellectual property rights to content
• Obtaining necessary licenses and permissions
• Compliance with copyright laws
• Compliance with content regulations
• Accuracy of content and metadata
• Legal consequences of content
• Civil and criminal liability

2.2 Indemnification Clause

By uploading content, users agree to INDEMNIFY, DEFEND, AND HOLD HARMLESS Drishyaalok and its owners, operators, employees, and affiliates from:

• Any claims, demands, or lawsuits arising from uploaded content
• Copyright infringement claims
• Defamation claims
• Privacy violation claims
• Any legal fees or damages incurred
• Regulatory penalties

3. "AS IS" AND "AS AVAILABLE" DISCLAIMER

3.1 No Warranties

The platform and all content are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

• Merchantability: No warranty that the service is fit for any particular purpose
• Availability: No guarantee of uninterrupted or error-free service

• Security: No guarantee that the platform is completely secure

4. LIMITATION OF LIABILITY

4.1 Maximum Liability Cap

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DRISHYAALOK'S TOTAL LIABILITY SHALL NOT EXCEED:

• The amount paid by the user in the past 12 months, OR
• ₹1,000 (One thousand Indian Rupees), whichever is less

4.2 Exclusion of Damages

IN NO EVENT SHALL DRISHYAALOK BE LIABLE FOR:

• Consequential Damages: Harm resulting from use or inability to use the service
• Punitive Damages: Penalties or exemplary damages
• Incidental Damages: Costs of substitute services
• Content-Related Harm: Harm caused by user-generated content
• Third-Party Actions: Actions or omissions of other users

5. COPYRIGHT DISCLAIMER

5.1 DMCA Safe Harbor

Drishyaalok qualifies for safe harbor protection under:

• Digital Millennium Copyright Act (DMCA) - USA
• Information Technology (Intermediary Guidelines) Rules, 2021 - India
• Similar safe harbor provisions worldwide

5.2 Notice and Takedown

• We respond promptly to valid DMCA takedown notices
• We remove infringing content upon proper notification
• We maintain a repeat infringer policy
• We do NOT monitor content proactively for copyright compliance

5.3 Direct Uploader Liability

Copyright infringement claims should be directed to the individual who uploaded the content, NOT to Drishyaalok.
