1. ACCEPTANCE OF TERMS

By accessing or using Drishyaalok ("the App", "we", "us", "our"), you ("User", "you", "your") agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App.

2. DISCLAIMER OF LIABILITY

2.1 Content Disclaimer

USER-GENERATED CONTENT: All content uploaded to this platform is user-generated. Drishyaalok is a platform provider and does NOT create, endorse, or verify any content.
NO EDITORIAL CONTROL: We do not exercise editorial control over user-uploaded content before publication.
LIABILITY WAIVER: Drishyaalok, its owners, operators, employees, and affiliates SHALL NOT BE LIABLE for any content uploaded by users.

2.2 Copyright Responsibility

USER RESPONSIBILITY: Users who upload content are SOLELY RESPONSIBLE for ensuring they own all rights or have obtained proper licenses for the content.
INDEMNIFICATION: By uploading content, you agree to indemnify and hold harmless Drishyaalok from any claims, damages, or legal actions arising from your uploaded content.
COPYRIGHT INFRINGEMENT: Any copyright infringement claims shall be directed to the individual uploader, not Drishyaalok.

2.3 Platform Limitation

INTERMEDIARY STATUS: Drishyaalok operates as an intermediary platform under the Information Technology Act, 2000 (India) and similar laws globally.

NO WARRANTIES: The platform is provided "AS IS" without warranties of any kind.

3. USER OBLIGATIONS

3.1 Content Upload Requirements

Users who upload content MUST:

Not upload any copyrighted material without authorization
Not upload obscene, defamatory, or illegal content
Comply with all applicable laws and regulations
Ensure content has appropriate age ratings

3.2 Age Restrictions

Users must be 13 years or older to use this app
Users under 18 must have parental/guardian consent
Age-restricted content (13+, 16+, 18+) will only be shown after user confirmation

3.3 Prohibited Content

4. INTELLECTUAL PROPERTY

This license terminates when content is deleted by the user

4.2 Platform Rights

Users may not copy, modify, or reverse-engineer the platform

5. DMCA AND COPYRIGHT COMPLIANCE

5.1 DMCA Takedown Process

We comply with the Digital Millennium Copyright Act (DMCA) and similar laws

We will respond to valid notices within 24-48 hours
Repeat infringers will have their accounts terminated

5.2 Counter-Notice

Users may submit counter-notices if they believe content was removed in error
Counter-notices must include user's contact information and statement under penalty of perjury

6. CONTENT MODERATION

6.1 Automated and Manual Review

We use automated systems and manual review to detect policy violations
Flagged content will be reviewed by our moderation team
Violating content will be removed without notice

6.2 User Reporting

Users can report inappropriate content using the "Report" button
All reports are reviewed by our moderation team
False reports may result in account penalties

7. ACCOUNT TERMINATION

We reserve the right to terminate accounts:

For violation of these Terms of Service
For uploading prohibited content
For repeated copyright infringement
For fraudulent activity
At our sole discretion for any reason

8. PAYMENT AND REFUNDS

8.1 Ticket Purchases

Some content requires ticket purchase
Tickets are per-content and non-transferable
Payments are processed through Google Play Billing
External payment links for in-app digital content are not permitted

8.2 Refund Policy

Refunds are granted only for technical issues preventing access
Refund requests must be made within 48 hours of purchase
No refunds after content has been fully watched

9. CONTENT RESPONSIBILITY AND PLATFORM NEUTRALITY

Drishyaalok OTT operates solely as a digital distribution platform that enables independent creators, filmmakers, and production houses to host and distribute content to audiences. The platform does not produce, control, or take full responsibility for third-party content uploaded or provided by creators, production houses, or content partners.

Responsibility for legality, accuracy, originality, rights ownership, and policy compliance remains with the creator, production house, or rights holder.

All content must comply with:

Google Play Developer Program Policies
Applicable local and international laws and regulations
Copyright and intellectual property laws
Community standards related to safety, legality, and appropriate content

Drishyaalok OTT reserves the right, at its sole discretion, to review, restrict, request edits or modifications, suspend, or remove content, and to block or terminate access for creators or partners who violate platform rules or applicable policies. Such actions may be taken without prior notice if content is found to violate Google Play policies, legal requirements, copyright laws, or community standards.

By submitting or publishing content on the platform, the creator or production entity acknowledges and agrees that they bear full responsibility for their content and that the platform acts only as a neutral hosting and distribution service provider.

10. MISLEADING, SECURITY, AND ADS COMPLIANCE

Users and creators must not post misleading descriptions, false promises, fake earning claims, or deceptive branding
Platform usage involving malware, spyware, hidden ads, or data theft is strictly prohibited
If ads are shown, adult ads and misleading ads are not allowed
Ad implementation must not degrade user safety or core user experience
