Content Uploader Agreement

⚠️ LEGALLY BINDING AGREEMENT

This is a legally binding agreement between you (the "Uploader") and Drishyaalok. By uploading content to this platform, you certify under penalty of perjury that all statements below are true and accurate.

FALSE STATEMENTS MAY RESULT IN CRIMINAL PROSECUTION AND CIVIL LIABILITY.

1. UPLOADER CERTIFICATION

By uploading content to Drishyaalok, you certify, warrant, and agree to the following:

1.1 Ownership and Rights

I certify that I am the original creator and copyright owner of the content, OR I have obtained all necessary licenses, permissions, and rights to upload and distribute this content on Drishyaalok.

1.2 No Copyright Infringement

I certify that the content does NOT infringe any copyright, trademark, patent, trade secret, or other intellectual property right of any third party.

This includes music, images, video clips, logos, or any other copyrighted material.

1.3 Consent and Releases

I certify that I have obtained written consent from all persons appearing in the content (actors, performers, subjects) for their likeness to be used, recorded, and distributed.

1.4 Legal Compliance

I certify that the content complies with all applicable laws, including but not limited to copyright laws, obscenity laws, defamation laws, and privacy laws.

1.5 Content Policy Compliance

I certify that the content complies with Drishyaalok's Content Policy and does NOT contain:

Pornography or sexually explicit material
Child sexual abuse material (CSAM)
Hate speech or harassment
Violence or graphic content (unless properly age-restricted)
Illegal content of any kind

1.6 Age Rating Accuracy

I certify that I have assigned an accurate age rating (13+, 16+, or 18+) to the content based on its themes, language, violence, and mature content.

1.7 No Pirated Content

I certify that this content is NOT pirated and is not a copy, recording, or derivative of copyrighted works from streaming services, theaters, TV channels, or other sources.

2. GRANT OF LICENSE

By uploading content, you grant Drishyaalok a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to:

Host, store, and cache the content on our servers
Stream and distribute the content to users
Create thumbnails and preview clips
Transcode the content to different formats and resolutions
Display the content in search results and recommendations
Use metadata (title, description, tags) for categorization

Note: You retain all ownership rights to your content. This license terminates when you delete the content.

3. INDEMNIFICATION AGREEMENT

YOU AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS:

Drishyaalok and its owners
Officers, directors, employees, and contractors
Agents, partners, and affiliates

FROM AND AGAINST any claims, demands, lawsuits, liabilities, damages, losses, costs, and expenses (including reasonable attorney's fees) arising from:

Your uploaded content
Copyright infringement claims
Defamation or privacy violation claims
Breach of this Agreement
Violation of any law or regulation
Violation of any third-party rights

4. LEGAL RESPONSIBILITY

4.1 Sole Responsibility

You acknowledge and agree that YOU ARE SOLELY RESPONSIBLE for:

All legal consequences of uploading content
Any copyright infringement claims
Any defamation or privacy lawsuits
Civil and criminal liability
Regulatory penalties or fines

4.2 Drishyaalok's Non-Liability

Drishyaalok is NOT responsible for your content and will not be a party to any legal disputes arising from your content. Any legal claims will be directed to you as the uploader.

5. CONTENT REMOVAL AND ACCOUNT TERMINATION

5.1 Voluntary Removal

You may delete your content at any time
Deletion may take up to 48 hours to propagate
Backup copies may persist for up to 90 days

5.2 Platform Removal Rights

Drishyaalok reserves the right to remove content and terminate accounts:

For violation of Content Policy
Upon receipt of valid DMCA takedown notice
Upon court order or legal request
For repeated policy violations
At our sole discretion for any reason

5.3 No Refunds

If your content is removed for policy violations, you are NOT entitled to any refunds of payments received from ticket sales.

6. DMCA COUNTER-NOTICE RIGHTS

If your content is removed due to a DMCA takedown notice that you believe is erroneous:

You may submit a counter-notice under penalty of perjury
Counter-notice must include your contact information
Counter-notice must state you have good faith belief content was removed in error
Content may be restored after 10-14 business days if no lawsuit is filed

7. PAYMENT AND REVENUE SHARING

7.1 Ticket Revenue

You may set ticket prices for your content (subject to platform minimums/maximums)
Revenue is shared: 70% to uploader, 30% to platform (after payment processing fees)
Payments are processed monthly via bank transfer
Minimum payout threshold: ₹1,000

7.2 Tax Responsibility

You are responsible for all tax obligations on earnings
You must provide accurate tax information (PAN, GSTIN if applicable)
Drishyaalok may withhold taxes as required by law

8. REPRESENTATIONS AND WARRANTIES

You represent and warrant that:

You are at least 18 years old (or have parental consent)
You have legal capacity to enter into this Agreement
All information provided is accurate and truthful
You will comply with all applicable laws
You will not engage in fraudulent or deceptive practices

9. GOVERNING LAW AND DISPUTE RESOLUTION

9.1 Governing Law

This Agreement is governed by the laws of India. Jurisdiction is in the courts of [Your City], India.

9.2 Arbitration

Disputes shall be resolved through binding arbitration
Arbitration conducted under Indian Arbitration and Conciliation Act, 1996
Single arbitrator appointed by mutual agreement

⚖️ UNDER PENALTY OF PERJURY

By uploading content, you declare under penalty of perjury that:

All certifications and statements in this Agreement are true and accurate
You have read and understand the Terms of Service
You have read and understand the Content Policy
You accept full legal responsibility for your content
You agree to indemnify Drishyaalok against any claims

FALSE STATEMENTS MAY RESULT IN CRIMINAL PROSECUTION FOR PERJURY AND CIVIL LIABILITY FOR DAMAGES.

10. ACKNOWLEDGMENT

I ACKNOWLEDGE THAT:

I have read this entire Uploader Agreement
I understand my legal obligations and responsibilities
I agree to be bound by this Agreement
I understand that Drishyaalok is an intermediary platform and not responsible for my content
I accept that any legal claims will be directed to me, not Drishyaalok
I agree to indemnify Drishyaalok against all claims related to my content
I certify all statements are true under penalty of perjury

By clicking "Upload" or submitting content, I accept this Agreement.
